Beta Program Notice: These terms apply specifically to the SMS Knowledge Assistant beta program. The service is provided "as-is" for testing and feedback purposes. Features, availability, and data handling may change.

1. Acceptance of Terms

By accessing or using the SMS Knowledge Assistant service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

By participating in the beta program, you also agree to the Beta Program Specific Terms in Section 9.

2. Beta Program Disclaimer

The SMS Knowledge Assistant is currently in beta testing. This means:

  • Service Availability: The Service may be unavailable, interrupted, or discontinued at any time without notice.
  • Features May Change: Features, functionality, and user interface may change significantly without notice.
  • Data Risk: While we take precautions, data loss is possible. We recommend keeping backups of important notes.
  • No Guarantees: We make no guarantees about uptime, response times, or data retention during the beta period.

3. Service Description

SMS Knowledge Assistant provides an AI-powered knowledge management system accessible via SMS. The Service includes:

  • Capturing and storing notes sent via SMS
  • AI-powered categorization, tagging, and summarization
  • Semantic search and relationship detection
  • Query commands for accessing your notes

The Service does NOT include:

  • Guaranteed uptime or availability
  • Automatic data backups (user responsibility during beta)
  • Customer support beyond email (during beta)
  • Mobile app access (future feature)

4. User Responsibilities

4.1 Appropriate Use

You agree to use the Service only for lawful purposes. You will NOT:

  • Send illegal, harmful, threatening, abusive, or harassing content
  • Transmit spam or unsolicited messages
  • Attempt to disrupt, overload, or impair the Service
  • Attempt to access other users' data or accounts
  • Use the Service to store sensitive data (passwords, financial info, health records) during beta
  • Reverse engineer or attempt to extract source code

4.2 Account Security

Your phone number is your account identifier. You are responsible for maintaining the security of your phone and any access to the Service.

4.3 Accurate Information

You agree to provide accurate information when registering for the beta program and to keep your contact information updated.

5. Intellectual Property

5.1 Your Content

You own all notes and content you submit. By using the Service, you grant us a limited license to:

  • Store, process, and display your content to provide the Service
  • Process your content through AI systems for categorization and search
  • Create derivative metadata (categories, tags, summaries) from your content

This license ends when you delete your account.

5.2 AI-Generated Metadata

Metadata generated by our AI (categories, tags, summaries, relationships) is provided as part of the Service. You may use this metadata for personal purposes. We retain no ownership of AI-generated metadata associated with your specific content.

5.3 Our Service

The Service, including its software, design, and technology, is owned by SMS Knowledge Assistant. These Terms do not grant you rights to our intellectual property except as needed to use the Service.

6. Account Termination

6.1 By You

You may terminate your account at any time by sending a deletion request to support@smska.example.com or using the /delete command. Upon termination:

  • You will receive a data export before deletion (upon request)
  • Your data will be deleted within 30 days
  • Backups may retain data for up to 30 additional days

6.2 By Us

We may terminate or suspend your account if you:

  • Violate these Terms of Service
  • Abuse the Service or other users
  • Engage in illegal activity

We may also terminate the beta program entirely at any time with reasonable notice.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, SMS Knowledge Assistant disclaims all warranties, express or implied, including:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of AI-generated content

We are not liable for: Data loss, service interruptions, AI errors, missed messages, or any indirect, incidental, special, or consequential damages.

Maximum Liability: Our total liability for any claim related to the Service is limited to $0 (zero dollars), as this is a free beta program.

8. Dispute Resolution

8.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@smska.example.com to attempt informal resolution. We will respond within 5 business days.

8.2 Governing Law

These Terms are governed by the laws of [Jurisdiction - to be determined]. Any disputes will be resolved in the courts of [Jurisdiction].

9. Beta Program Specific Terms

9.1 Feedback

As a beta participant, you agree to:

  • Provide feedback on your experience (via surveys, interviews, or messages)
  • Report bugs and issues you encounter
  • Allow us to use your feedback to improve the Service

Feedback Ownership: Any feedback, suggestions, or ideas you provide become our property to use without compensation or attribution.

9.2 No Compensation

Beta participation is free. You will not receive monetary compensation for your participation or feedback.

9.3 Confidentiality

While we don't require a formal NDA, we ask that you not publicly share details about unreleased features without our permission.

9.4 Beta Duration

The beta program will run for approximately 4-6 weeks. We will provide at least 7 days notice before ending the beta or transitioning to a paid service.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via SMS or email at least 7 days before they take effect. Continued use of the Service after changes constitutes acceptance.
